Please read our affiliate terms and conditions carefully before you join our program or begin marketing of our program. These terms and conditions are written in plain terms intentionally avoiding legalese to ensure that they may be clearly understood and followed by affiliates. Adherence to the terms and conditions provides that our Hickies.com affiliate program is sustainable and profitable for both Hickies.com and our affiliates.
DEFINITIONS
As used in the below Terms: (i) "We", "us", or "our" refers to Hickies.com; (ii) "you" or "your" refers to the Affiliate; (iii) "our website"refers to the Hickies.com website located at www. Hickies.com; (iv)"your website" refers to any websites that you will link to our website; (v) "Program" refers to the Hickies.com Affiliate Program.
COUPON GUIDELINES
If you are enrolled in our Program and your Website promotes coupon codes, you must adhere to our Coupon Guidelines as follows:
1.    You may ONLY advertise coupon codes that are provided to you through the affiliate program or network.
2.    You may NOT advertise coupon codes obtained from our non-affiliate advertising, customer e-mails, paid search, or any other campaign.
3.    Violation of these terms may result in removal from the Hickies.com affiliate program, reversal of sales, or reduction in commissions.
PPC GUIDELINES
If you are enrolled in our Program and participate in PPC advertising, you must adhere to our PPC guidelines as follows:
1.    You may not bid on any of our trademarked terms, including any variations or misspellings thereof for search or content based campaigns on Google, MSN, Yahoo or any other network. These trademark terms include Hickies.com, Hickies, www. Hickies.com, and similar terms unless given written permission.
2.    Coupon and review sites may not bid on or show up for any of our trademarked terms or any misspelling of those terms on Google Adwords or Bing ads (Yahoo|Bing Network). As an exception to this policy, coupon sites may bid on our branded/trademarked terms in combination with promotional terms like "Hickies coupons" or "Hickies reviews" when the keyword is targeted to the coupon or review site without expressed written consent.
3.    You may not direct link to our website from any Pay Per Click ad or use redirects that yield the same result. Affiliates must be directed to an actual page on your website without expressed written consent.
If you automate your PPC campaigns, the responsibility is yours to exclude our trademark terms from your program and we strongly suggest you add our trademarked terms as negative keywords. If you violate these PPC guidelines your current and past commission will be set to 0% without warning.

DOMAIN NAMES
You may use of any of our trademarked terms as part of the domain or sub-domain for your website i.e. Hickies.website.com or www.website.com/ Hickies
ADVERTISING & PUBLICITY
You shall not create, publish, distribute, or print any written material that makes reference to our Program without first submitting such material to us and receiving our prior written consent. If you intend to promote our Program via e-mail campaigns, you must adhere to the following:
1.    Abide by the CAN-SPAM Act of 2003 (Public Law No. 108-187) with respect to our Program.
2.    E-mail must be sent on your behalf and must not imply that the e-mail is being sent on behalf of Hickies.com
3.    E-mails must first be submitted to us for approval prior to being sent.
NEXUS AFFILIATE RESTRICTIONS
Prohibition against solicitation activities by resident affiliates in any of the current Nexus states.  As a condition of its participation in the Hickies.com Affiliate Program, Affiliate agrees that its solicitation activities on behalf of Hickies.com within these Nexus states be limited to providing a link on Affiliate’s website to the Hickies.com website. Affiliate acknowledges that under current State Law in the current Nexus states further solicitation and promotional activities by Affiliate within their respective state may subject Hickies.com to liability for collecting sales tax in that state. Therefore, Affiliate is prohibited from engaging in any solicitation activities in the current Nexus states  intended to refer potential customers to Hickies.com, including, but not limited to: distributing flyers, coupons newsletters and other printed materials, or electronic equivalents of such materials, engaging in verbal solicitation, including in-person referrals or initiating telephone calls, and sending emails intended to refer customers to Hickies.com.
