At Ferryhopper, we make a point of working with affiliates who comply and respect the following conditions: closed brand bidding, prohibited verticals (such as gambling, adult content, etc.), cookie window of 30 days, and custom conditions specific to certain campaigns or promotions.

We forbid marketing practices such as spamming, deceptive advertising, cookie stuffing, bot traffic, unauthorized paid traffic, and other fraudulent methods to generate poor quality, false, deceptive or otherwise misleading traffic, prohibit content for illegal activities, hate speech, misinformation, and maintain strict guidelines to prevent fraud. 1. TICKET BOOKING PROCESS 1.1. Ferryhopper shall provide the Affiliate with the necessary technical specifications and layout guidelines for generating tracking Links that redirect Users to the Ferryhopper platform. Both Parties shall cooperate to optimize the effectiveness of such Links (e.g., improved redirection time or relevance of landing pages). 1.2. Users who complete a transaction via the Ferryhopper platform shall be deemed customers of Ferryhopper. Ferryhopper shall be solely responsible for managing the entire customer relationship, including but not limited to: (i) setting booking prices; (ii) accepting, processing, and fulfilling bookings; (iii) collecting payments, taxes, and applicable fees; (iv) handling changes, cancellations, and refunds; (v) ensuring legal compliance; (vi) providing customer service; and (vii) meeting any obligations from completed transactions.

2. PAYMENT TERMS 2.1. Ferryhopper shall pay the Affiliate a commission on a cost-per-acquisition (“CPA”) basis for each Referral resulting in a successful booking. 2.2. Referrals that do not result in bookings due to technical issues not attributable to Ferryhopper (e.g., timeouts, ferry operator issues, invalid routes) are excluded from the CPA obligation. Voluntary changes or cancellations by Users shall not impact the commission, which is calculated based on the initial booking. 

3. INTELLECTUAL PROPERTY RIGHTS 3.1. Each Party retains all rights to their respective intellectual property, including (but not limited to) trademarks, logos, trade names, and proprietary tools or data. 3.2. Neither Party may reproduce, distribute, or use the intellectual property of the other except as expressly permitted by this Agreement.

4. CONFIDENTIALITY 4.1. Each Party shall protect the other’s Confidential Information with reasonable care and use it solely for the purposes of this Agreement. Disclosure is permitted only with written consent or under legal obligation, and on a strict need-to-know basis. 4.2. “Confidential Information” includes non-public business, financial, and technical data, usage statistics, personal data, and terms of this Agreement. It excludes information: (i) already known without restriction; (ii) independently developed without use of the other’s confidential material; or (iii) lawfully received from a third party.

5. PERSONAL DATA PROTECTION 5.1. Both Parties declare compliance with EU and Greek data protection laws, including the GDPR. 5.2. Each Party shall act as an independent Controller for any personal data processed under this Agreement.

6. ENTIRE AGREEMENT, AMENDMENTS, AND INTERPRETATION 6.1. This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements. 6.2. Amendments must be in writing and signed by authorized representatives of both Parties.

7. NOTICES

Any notice permitted or required to be given to a Party under the Agreement must be in writing and delivered by prepaid registered mail to the address of the other party stated in this agreement or such other address as the other party has notified, or by electronic mail, the receipt of which has been confirmed. A notice shall be deemed to have been given at the date of mailing of the registered mail or at the date of sending in the case of a confirmed electronic mail in accordance with the foregoing.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1. This Agreement shall be governed by and construed in accordance with the laws of Greece.

8.2. The Parties agree that in the event of disagreement or dispute concerning the scope, meaning construction or effect of this Agreement, will work to resolve the disagreement or dispute between them.

8.3. Should the Parties fail to resolve, the courts of Athens in Greece shall have the jurisdiction in regard to any dispute which may arise pursuant to this Agreement.
