Your earnings:

6.65% for new customers
3.8% for guest customers
3.8% for existing customers
Voucher portals receive a 2.85% commission on every sale
Regular end customer and partner campaigns and
individual commissions for publishers are possible by arrangement.

Post-view tracking and brand bidding are prohibited unless EMP has given express written consent to the use of these methods.

Scope / subject of the contract

The terms and conditions apply to the EMP affiliate program integrated here. They regulate the cooperation with our publishers.

The partner affirms that he is at least 18 years old and has full legal capacity.
Registration takes place by submitting the application form for a partner program to EMP.
We reserve the right to reject the application if we are of the opinion that the partner's website is not suitable for our partner program.
 

Partner's obligations

The partner can advertise EMP on their own website. The partner bears the costs for the advertising measures himself.

By registering for the partner program, the partner undertakes to observe the following:

Trademark infringements are to be avoided
The partner is responsible for the proper integration of the EMP advertising material
Advertising material must be removed by the partner if EMP requests it
Clicks on advertising material displayed on the partner site must forward the user directly to the EMP shop
Short-term changes must be possible
Compliance with trademark rights must be ensured
The partner side must not give the impression that EMP is legally represented
The partner's website must comply with all relevant statutory regulations and data protection laws
A complete, legally correct imprint must be available
The partner's website may neither positively rate nor advertise illegal activities, nor contain representations of discriminatory statements on the following topics: any kind of violence, pornographic content, gender, religion, nationality, disability, sexual orientation, age, political and religious concerns, erotic areas , Gambling areas and banner farms.
Links or the creation of meta tags on the above-mentioned content are prohibited
The following activities are prohibited without the consent of EMP:
Retargeting activities
Integration of advertising material on Facebook pages
Post View Activities
Use of triple banners
SMS and MMS as advertising media
Sending unsolicited e-mails containing advertising or other advertising measures that require the recipient's consent
The use of trademarks and copyrights of EMP that go beyond the use of the agreed advertising presentation
Advertising with the contractual relationship or with EMP as a reference
The use of an additional website or an e-mail as an advertising medium; The only advertising medium is the website registered in the EMP partner program
Advertising materials are created by EMP and may not be changed by the partner
EMP must not be integrated in the form of a frame
The application of the EMP partner program via search engine marketing is expressly not permitted. Likewise, EMP may not be advertised using pop-ups, layer ads, adware and forced click forms of advertising
 

Liability of the partner

The partner must ensure that his website fully meets the above requirements. He will exempt EMP from any claims by third parties and hold it harmless if such claims are related to the operation of his website, an act or omission by himself, a representative, employee, contractor or vicarious agent or is otherwise attributable to him.

EMP's liability

EMP is fully liable for damage caused by EMP or its vicarious agents willfully or through gross negligence.
According to the mandatory provisions of the Product Liability Act, EMP is liable for claims arising from initial inability or impossibility for which it is responsible.
If EMP culpably violates an essential contractual obligation, the obligation to pay compensation is limited to the foreseeable, typically occurring damage.
In order to ensure the functionality of the partner program, EMP will take all reasonable and economically justifiable measures, insofar as this is within the responsibility and sphere of influence of EMP.
The partner is responsible for the functionality of the partner websites. EMP does not guarantee that the partner's website will function properly and be available.
The content and design of the partner websites are beyond EMP's sphere of influence. EMP hereby expressly distances itself from this.
If the partner causes damage and the resulting claims by third parties, EMP is not liable for this. The partner expressly releases EMP from such third party claims.
EMP does not provide any guarantee towards the partner and does not give any assurances with regard to the availability of products or possible changes in product conditions.
 EMP is not liable in the event that an end customer mediated by a partner does not accept the setting of cookies and the sales generated by this cannot be assigned to the partner.
EMP

is not liable for lost commissions due to incorrect advertising integration.

compensation

The partner receives a commission for every purchase made using the integrated advertising material.
The amount of the commission can be found in the partner network. (The amount of the commission is 4.00% - 7.00% per sale / voucher portals receive 3% per sale.)
EMP reserves the right to change the amount of the commission.
If the purchase made is partially or completely canceled, the corresponding commission is waived.
The EMP standard cookie runtime is 30 days and for Post View 24 hours. EMP reserves the right to adjust these at any time.
An order must be placed within 30 days of clicking on the advertising material. If a longer period elapses, the order will not be reimbursed.
If the partner violates the terms and conditions, EMP is entitled to suspend and withhold all services related to the partner and to withdraw the outstanding commission for the previous four weeks.
 

Contract duration / termination

The cooperation between EMP and the partner is concluded for an indefinite period.
The contract can be terminated by either party at any time with a notice period of 7 days.
The right to extraordinary termination remains unaffected by the above conditions.
After termination of the contract, the partner must immediately delete the advertising material and information that was provided to him.
 

Final provisions

EMP has the right to change the terms and conditions at any time. The partner will be informed of changes by email. He can object in writing within 30 days and terminate the partner program. If neither an objection nor a termination is received within this period, the new terms and conditions are deemed to have been accepted.
Changes and additions to this contract must be in writing. Verbal collateral agreements do not exist.
Should individual provisions of this contract be or become ineffective or unenforceable, this shall not affect the validity of the remaining provisions of this contract. EMP and the partner will try to replace the ineffective or unenforceable provision with a new provision that comes as close as possible in legal and economic terms to the ineffective, unenforceable provision. The same applies to a loophole.
