This campaign pays out a variable click commission based on the link you use from the product feed or link manager. (1). Affiliate shall not use any intellectual property (including but not limited to Domain Names; Trademarks; Servicemarks and/or copyrighted material) of the Client nor any information or content of any sort provided by Client to Pepperjam and/or Affiliate in any form of search engine marketing nor will Affiliate in any form or fashion bid on any keywords.
(2). Affiliate shall not use any intellectual property (including but not limited to Trademarks; Servicemarks and/or copyrighted material) of the Client nor any information or content of any sort provided by Client to Pepperjam and/or Affiliate as keywords or metatags in any of Affiliate’s website(s).
(3). Affiliate shall not bundle any software applications with the exception of that provided by Client and/or Pepperjam to any entity or individual that uses Client's Distribution Medium provided to Affiliate under the terms of this Agreement.
(4). Affiliate shall not send, transmit and/or distribute any Advertisement(s) by any type of email. Affiliate shall not distribute Client Advertisement(s) in any form or fashion except by placing the Advertisement with the content exactly as provided by Client Pepperjam and Affiliate on the Affiliate's web site. Affiliate may make formatting modifications as may be necessary for display on the Affiliate's Distribution Medium.
(5) Affiliate will certify via Affidavit that any use of browser extensions or any type of scripts and/or software that alter the user experience on Crutchfield.com and/or any third party website have been disclosed to Crutchfield.
(6) Client shall not pay advertising fees on purchases of gift cards; taxes or shipping fees; purchases made via the Crutchfield Installment Plan; or any portion of an order paid with Crutchfield Rewards credit.
(7) Affiliate shall not direct visitors to crutchfield.ca, business.crutchfield.com, or any urls containing ‘SupportByCrutchfield.’ Client shall not pay advertising fees on purchases originating from a link to one of these domains or urls.

Contract Clause-PepperJam Network (PepperJam)
Affiliate covenants that it and its agents and representatives do not, and will not, engage in any solicitation activities in the States listed below regarding the Crutchfield Site (Crutchfield.com) or Crutchfield that refer potential customers to Crutchfield for the purpose of purchasing products or services from Crutchfield. Such solicitation activities include: distributing in these states promotional materials such as newsletters, flyers and coupons; initiating in these states email or telephone solicitation; and/or engaging in verbal (face-to-face) solicitations in said states in connection with any seminars, conferences and other meetings. Affiliate agrees to provide to Crutchfield on an annual basis a certificate in the form of the attached.

Crutchfield Corporation does not enter into affiliate relationships with any entity that is a resident of New York, Georgia, California, Pennsylvania, Maine, Minnesota, Missouri, Kansas, Rhode Island, North Carolina, Arkansas, Wyoming, Illinois, Vermont, New Jersey, or Connecticut. With your electronic signature (acceptance into the affiliate program), and for good and valuable consideration, the sufficiency of which is hereby acknowledged, the undersigned is representing and warranting to Crutchfield Corporation (and is aware that Crutchfield Corporation is relying on this affidavit) that:
(1) The entity signing the affidavit is not currently a resident of the states of New York, Georgia, California, Pennsylvania, Maine, Minnesota, Missouri, Kansas, Rhode Island, North Carolina, Arkansas, Wyoming, Illinois, Vermont, New Jersey, or Connecticut.
(2) That the entity signing the affidavit acknowledges and agrees that it will not become a resident of the states of New York, Georgia, California, Pennsylvania, Maine, Minnesota, Missouri, Kansas, Rhode Island, North Carolina, Arkansas,Wyoming, Illinois, Vermont, New Jersey, or Connecticut without first giving Crutchfield Corporation 40 days prior notice that it is about to become a resident of and/or is taking any action that would result in it becoming a resident of the state of New York, Georgia, California, Pennsylvania, Maine, Minnesota, Missouri, Kansas, Rhode Island, North Carolina, Arkansas, Wyoming, Illinois, Vermont, New Jersey, or Connecticut.
(3) That the entity signing this affidavit hereby acknowledges and agrees that if it should violate any of the terms of the affidavit, any affiliate relationship which it may have with Crutchfield Corporation will terminate immediately without the need of notice.
(4) That the entity signing this affidavit agrees to indemnify and hold harmless Crutchfield Corporation against any loss, liability, damages, claims and expenses (including attorneys' fees) which Crutchfield may suffer from because of any misinformation or misrepresentation given to Crutchfield Corporation by the entity signing this affidavit.
